International Classifications Scheme For Intellectual Property Rights
Classification is the essential part in Intellectual Property Right. So we can see uniformity in Intellectual Property Rights in Internation level. Anyone applying for a patent or registering a trademark or design, whether at the national or international level, is required to determine whether their creation is new or is owned or claimed by someone else. To determine this, huge amounts of information must be searched. WIPO ) created classification systems which organize information concerning inventions, trademarks, and industrial designs into indexed, manageable structures for easy retrieval. Regularly updated to include changes and advances in technology and commercial practices, the classification systems are used voluntarily by many countries which are not member States of the related agreements.
There are 4 Classification Scheme for international classifications of Intellectual Property Rights
1. International Patent Classifacation (IPC)
2. Nice Classification
3. Locarrno Classification
4. Vinenna Classification
(1) International Patent Classifacation (IPC): The Purpose of this Classification scheme is obtaining an internationally uniform classification of patent documents. Its primary purpose the establishment of an effective search tool for the retrieval of patent documents by intellectual property offices and other users, in order to establish the novelty and evaluate the inventive step or non-obviousness (including the assessment of technical advance and useful results or utility) of technical disclosures in patent applications
(2) Nice Classification: The Nice Classification consists of a classification of goods and services for the purposes of registering trademarks and service marks.
(3) Locarno Classification: It consists of a classification for industrial designs.
(4) Vinenna Classification: The purpose of the Classification is essentially the practical one of facilitating trademark anticipation searches and obviating substantial reclassification work when Documents are exchanged at the international level.
